TERMS & CONDITIONS

REFUND AND RETURNS

Deposits are non-refundable unless otherwise stated in writing.  Client must provide Photographer any notice of a cancellation in writing. If Client does not provide written notice of any Cancellation, then Photographer may assess any higher Cancellation Fee. Photographer reserves the right to invoice Client for any amount by which the Master Account exceeds the total of any Deposit made by Client. Photographer will return any unused portion of monies to Client no later than thirty (30) days after application of any Cancellation Fee.

COPYRIGHT & USAGE

All photographs remain the intellectual property of the Photographer. The Client is granted personal usage rights only. Commercial use, resale, or publication requires written consent and may incur additional licensing fees. The Photographer may use select images for portfolio, website, and promotional purposes unless the Client requests otherwise in writing. 

IMAGE STORAGE, ARCHIVING & DATA PROTECTION 

Photographer shall deliver final images with in (4) weeks after Event. All images will be delivered via “Pass+”, a digital photo delivery mechanism. Photographer will store final edited images for 30 days from the date of delivery. After this period, images may be permanently deleted. It is the Client’s responsibility to download, back up and securely store their images upon delivery. Replacement of lost images after storage period cannot be guaranteed and may incur an additional fee if retrieval is possible 

TRAVEL & EXPENSES

 For events outside 50 miles of Fort Worth, Texas, additional travel fees may apply. Travel fees may include standard mileage rate reimbursement, airfare, lodging, and other necessary expenses. Travel time beyond (2) hours each way may be billed at $50.00 per hour. All travel-related costs will be approved in advance and added to the Client’s Master Account.  

FORCE MAJEURE

Either party may cancel the Agreement without liability to the other party upon the occurrence of any event or circumstance beyond the control of such party, including acts of God, declared war in the United States, acts of terrorism in the city where the Event premises is located, government regulations, disaster, strikes or civil disorder, curtailment of transportation that prevents at least fifty percent (50%) of the attendees from attending the event, to the extent that the above described event(s) or circumstance(s) makes it illegal or impossible for Photographer to provide, or for Client in general to use, the premises of Photographer. The Agreement cannot be cancelled under this section because of general economic conditions, including (without limitation) any recession or budget cut. Either party that wishes to cancel the Agreement pursuant to this section must provide written notice to the other party identifying the event or circumstance that is the basis for such cancellation within ten (10) days after learning about such event or circumstance. This provision shall not, however, relieve either party from using its reasonable commercial efforts to avoid, remove or mitigate such force majeure event and to continue performance with reasonable dispatch whenever such causes are removed. If the Agreement is duly cancelled under this Section, then Photographer shall, within thirty (30) days after such cancellation, refund any deposits made by Client.
